[May Point Network] In late May, the revised "Team Outbound Tourism Contract (Demonstration Text)" and "Mainland Residents to Taiwan Tourism Contract (Demonstration Text)" will be put into use in the Shijiazhuang tourism market. The contents of the new version of the outbound travel contract and the Taiwan travel contract are very detailed and clear. They make reasonable and reasonable agreements on the possible disputes in the tourism activities. At the same time, it is most likely to trigger the shopping activities and the activities that require additional payment. The matter of the dispute was clearly agreed for the first time.

Grouping and transferring groups must be notified in advance

Many people have encountered this situation: they signed up for a tour group of a travel agency until they found out that they were "spelled" into a large group of another travel agency.

In the new version of the outbound travel contract, the group mode is clearly listed as one of the contents of the “contract mark”. In the contract use instructions, it is also clear that when the outbound community fights the group and transfers the group, the traveler’s written consent should be obtained in advance. Xing Wenhai, director of the Shijiazhuang Tourism Quality Supervision Institute, said that this method of clear group formation in the contract and the attention of both parties to the contract before the contract is signed can greatly reduce the dispute caused by the unclear contract.

The new version of the outbound travel contract expressly requires that the exit agency not transfer the tourists to the group or the group without the consent of the tourists. If the tourists know before the departure (excluding the day), they have the right to cancel the contract, and the exit agency will refund the full amount. Travel expenses, and pay a penalty of 15% of the total travel expenses.

In addition, according to the "Regulations on Tourism Cooperation between the Two Sides of the Taiwan Straits," mainland residents may not transfer to the group if they are less likely to form a group than the group. Traveling to Taiwan travel agencies can negotiate with tourists to postpone travel or change to a tourist route outside of Taiwan.

For the first time, the "force majeure" factor

For the first time, the new version of the outbound travel contract and the Taiwan tour contract clearly stated “force majeure”, which refers to objective conditions that cannot be foreseen, cannot be avoided and cannot be overcome, including but not limited to natural and social causes, such as natural disasters. War, terrorist activities, turmoil, riots, strikes, public health emergencies, government actions.

At the same time, it also clarifies the meaning of “accidents”, which refers to incidents caused by accidental factors other than intentional or negligent, including but not limited to traffic congestion caused by major concierge activities, late train flights, and temporary open spots.

The "Model Text" requires that if a force majeure or accident occurs before the trip, the two parties may cancel the itinerary or postpone the trip after negotiation. If the itinerary is cancelled, the travel agency will refund the full amount of the tour fee to the visitor (the visa/endorsement fee incurred can be deducted). If the travel expenses have already occurred, they shall be reasonably shared after consultation between the two parties. If the force majeure is encountered during the itinerary and the contract cannot be fulfilled, the travel agency shall refund the tourist expenses that have not occurred to the tourists, and the increased travel expenses shall be reasonably shared by both parties after consultation. If an unexpected event occurs during the itinerary and the contract cannot be fulfilled, the travel agency will refund the tourist expenses that have not occurred to the visitor. Therefore, the increased travel expenses will be borne by the party who proposed the change (but due to emergency hedging, the beneficiary will bear) .

Travel agency forced shopping

To compensate visitors for 20% liquidated damages

For the self-funding and shopping problems that often occur during the travel process, the Model Text has been more detailed. The "Demonstration Text" requires that if the travel agency leader or overseas tour guide signs the additional payment items other than those stipulated in the contract without the signature of the tourists, they shall bear the expenses for the separately paid project without authorization; increase the number of purchases without authorization, and each time the travel expenses are 10%. Tourists pay liquidated damages; if the travel agency forces or disguise the tourists to shop, each time 20% of the total travel expenses are paid to the tourists. (Yanzhao Evening News)
